By using the Bebsa Banao POS, CRM, inventory, and journal ecosystem, you agree to these terms. Please read them carefully as they contain important legal rights and obligations.
We encourage you to evaluate our service during the free trial period before subscribing. Please review our full terms below, including the payment terms in Section 3 and 4.
Account Terms
You must be at least 18 years old to use this service. You are responsible for maintaining the security of your account and password. Bebsa Banao cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You must provide accurate, current, and complete information during registration and keep your account information updated. You are responsible for all activity that occurs under your account.
Payment Terms
Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen plan. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you are responsible for payment of all such taxes. If your payment method fails, we may suspend access to your account until payment is successfully processed. We reserve the right to change our pricing with 30 days written notice.
Service Usage Rules
Our POS, CRM, inventory, and journal systems are provided on an 'as is' and 'as available' basis. You agree not to misuse the service, including but not limited to attempting to access another user's account, transmitting malware, interfering with the service's operation, or using the service for any illegal purpose. We reserve the right to suspend or terminate accounts that violate these terms.
1. Acceptance of Terms
Binding Agreement
By accessing or using the Bebsa Banao platform, including our Point of Sale (POS) system, Customer Relationship Management (CRM) tools, inventory management, journal features, and all related services (collectively, 'the Service'), you agree to be bound by these Terms and Conditions. If you do not agree to all terms, you must not access or use the Service.
Updates to Terms
We reserve the right to update or modify these terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of the Service after any changes constitutes acceptance of the new terms. We will notify registered users of material changes via email.
Governing Law
These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in India.
2. Eligibility & Registration
Age Requirement
You must be at least 18 years of age to register for and use the Service. By registering, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.
Business Entity
If you are registering on behalf of a business or other legal entity, you represent and warrant that you have the authority to bind that entity to these terms. The business name, address, and other registration details you provide must be accurate and complete.
Account Security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account.
Multiple Accounts
You may not create multiple free accounts or free trial accounts to circumvent the terms of our pricing plans. We reserve the right to merge or terminate duplicate accounts.
3. Subscriptions & Billing
Subscription Plans
The Service is offered on a subscription basis with various plans. The features, limits, and pricing of each plan are described on our pricing page. We reserve the right to modify plan features and pricing with 30 days notice.
Billing Cycle
Subscriptions are billed in advance on the first day of each billing period. Monthly plans are billed each calendar month. Annual plans are billed once per year. The billing date is determined by your original subscription date.
Auto-Renewal
All subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your provided payment method for all renewal fees. Cancellation takes effect at the end of the current billing period.
Taxes
You are responsible for all applicable taxes, including but not limited to GST, VAT, sales tax, or any other government levies. The listed subscription prices may or may not include applicable taxes depending on your jurisdiction.
Payment Methods
We accept various payment methods as displayed during checkout. You represent and warrant that you have the legal right to use any payment method you provide. If a payment fails, we may attempt to charge your payment method again and may suspend your account until payment is successful.
4. No Refund Policy
Strict No-Refund Policy
ALL PAYMENTS MADE TO BEBSA BANAO ARE STRICTLY NON-REFUNDABLE. This includes all subscription fees, setup fees, add-on fees, and any other charges. By completing a purchase, you expressly waive any right to a refund, chargeback, or credit, regardless of the circumstances.
No Partial Refunds
No partial refunds or credits will be issued for partially used subscription periods, early termination, downgrades, or temporary service interruptions. If you cancel your subscription mid-cycle, you will continue to have access until the end of the paid period, but no prorated refund will be provided.
No Satisfaction Refunds
We do not offer satisfaction guarantees or money-back guarantees. We encourage all potential subscribers to thoroughly evaluate the Service during any free trial period before committing to a paid subscription.
Chargebacks
If you initiate a chargeback or payment dispute with your bank or payment provider, your account will be immediately suspended, and you will be liable for all fees incurred by us in connection with the dispute, including chargeback fees and collection costs.
Exceptions
The only exception to this no-refund policy is if we permanently discontinue the Service entirely without providing an alternative service. In such a case, refunds will be provided on a prorated basis for the unused portion of your subscription.
5. Data Ownership & Content
Your Data
You retain full ownership of all data, content, and information you enter into the Service, including but not limited to customer records, transaction data, product catalogs, journal entries, reports, and business documents. We claim no intellectual property rights over your data.
License to Operate
By using the Service, you grant us a limited, non-exclusive license to access, use, process, copy, store, and transmit your data solely as necessary to provide, maintain, and improve the Service. This license terminates when you delete your data or close your account.
Data Accuracy
You are solely responsible for the accuracy, quality, and legality of the data you input into the Service. We are not responsible for verifying or validating your data.
Aggregated Data
We may use anonymized, aggregated data derived from all users for analytical purposes, service improvement, and benchmarking. This aggregated data cannot identify you or your business.
6. Prohibited Activities
Illegal Use
You may not use the Service for any illegal purpose or in violation of any applicable laws or regulations. This includes but is not limited to fraud, money laundering, tax evasion, and operating businesses in regulated industries without required licenses.
Abusive Conduct
You may not use the Service to transmit any harmful code, malware, viruses, or other malicious technology. You may not attempt to gain unauthorized access to our systems or other users' accounts. You may not engage in any activity that disrupts or interferes with the Service.
Misrepresentation
You may not impersonate any person or entity, misrepresent your affiliation with any person or entity, or provide false or misleading information during registration or use of the Service.
Resale Prohibited
You may not resell, sublicense, rent, lease, or distribute the Service or any portion thereof to any third party without our prior written consent.
7. Limitation of Liability
No Warranties
THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
Limitation of Damages
IN NO EVENT SHALL BEBSA BANAO, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SERVICE.
Maximum Liability
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Data Loss
WHILE WE MAINTAIN REGULAR BACKUPS AND DISASTER RECOVERY SYSTEMS, WE ARE NOT LIABLE FOR ANY LOSS, CORRUPTION, OR BREACH OF YOUR DATA. YOU ARE ADVISED TO MAINTAIN YOUR OWN BACKUPS OF CRITICAL BUSINESS DATA.
8. Account Suspension & Termination
Termination by You
You may terminate your account at any time through your account settings. Termination takes effect immediately. You will continue to have access to the Service until the end of your current billing period, after which your account will be deactivated.
Termination by Us
We reserve the right to suspend or terminate your account at any time for violation of these terms, illegal activity, non-payment, or any other reason at our sole discretion. We will provide notice where practicable.
Effect of Termination
Upon termination, your right to access and use the Service ceases immediately. We will delete or anonymize your data within 90 days of termination, subject to legal retention requirements. You are encouraged to export your data before termination.
Survival
Sections of these terms that by their nature should survive termination shall survive, including but not limited to data ownership, limitation of liability, no refund policy, and governing law.
9. Security & Backup
Our Security Measures
We implement and maintain industry-standard security measures to protect your data, including AES-256 encryption at rest, TLS 1.3 encryption in transit, role-based access controls, and 24/7 security monitoring. However, no security system is impenetrable, and we cannot guarantee absolute security.
Your Security Obligations
You are responsible for implementing reasonable security measures on your end, including using strong passwords, not sharing login credentials, maintaining updated software, and securing your network and devices.
Backup Policy
We perform automated encrypted backups of all customer data multiple times daily with geographically redundant storage. In the event of data loss, we will use our backups to restore your data. However, we are not responsible for data loss resulting from your actions or omissions.
Breach Notification
In the event of a data breach that affects your personal or business data, we will notify you within 72 hours of discovery and take immediate steps to mitigate the impact.
10. Third-Party Services
Integrations
The Service may integrate with third-party services and platforms. We are not responsible for the content, policies, or practices of any third-party services. Your use of integrated third-party services is at your own risk and subject to their terms.
Payment Processors
Payment processing is handled by third-party payment processors. We do not store full credit card numbers or banking details. The payment processor's terms and privacy policy apply to your payment information.
No Endorsement
References or links to third-party services do not constitute endorsement. We disclaim all liability for any loss or damage arising from your use of third-party services.
11. Intellectual Property
Our IP
The Bebsa Banao platform, including its software, code, design, trademarks, logos, trade names, and all related intellectual property, is owned exclusively by Bebsa Banao Technologies. You may not copy, modify, reverse engineer, or create derivative works without our express written consent.
Feedback
If you provide us with feedback, suggestions, or ideas for improving the Service, you grant us a perpetual, irrevocable, royalty-free license to use such feedback without any obligation to you.
Reservation of Rights
All rights not expressly granted to you under these terms are reserved by Bebsa Banao Technologies.
12. Indemnification
Your Indemnity
You agree to indemnify, defend, and hold harmless Bebsa Banao Technologies, its directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service, (b) your violation of these terms, (c) your violation of any law or regulation, or (d) any data or content you submit to the Service.
13. General Provisions
Entire Agreement
These terms constitute the entire agreement between you and Bebsa Banao regarding your use of the Service and supersede all prior agreements and understandings.
Severability
If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Waiver
Our failure to enforce any right or provision of these terms shall not be deemed a waiver of such right or provision.
Force Majeure
We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, government actions, internet outages, or power failures.
Assignment
You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign our rights and obligations freely.
